It is decided to follow the following procedure considering the directions of how to give the effect of horizontal reservation given in each category. As far as women reserves are concerned, the same category of reserved seats i.e. Scheduled Castes (SC), Scheduled Tribes (ST) and Socially and Educationally Backward Classes (SEBC) seats will be reserved for them in Horizontal Reservation.
That is, women in the category of Scheduled Castes, Scheduled Tribes or Socially and Educationally Backward Classes in the Horizontal Reservation will not be able to leave their category and compete in the mutual reserved category. In addition, women candidates of general class will not be able to compete against the reserved category but the names in Mercury-2 regarding the seats which are not for Scheduled Caste, Scheduled Tribe or Socially and Educationally Backward Classes among the horizontal reservations.
As specified by the Court as follows. —-
There is no reservation for posts in the General Category, and horizontal reservation in favor of women in the General Category is available to be filled up from amongst all women irrespective of their caste status ……. 3.
In these circumstances, women of all categories will be able to compete for the general category of seats in the women’s reserve and these vacancies will have to be filled on merit basis, i.e. Open Merit. .
